They configure various pay rules, including daily and/or weekly overtime and meal breaks to stay compliant with the Fair Labor Standards Act (FLSA). For their California employees, they typically setup the Meal Break rules and penalties to protect their business.
According to the FLSA, nonexempt employees, such as servers and retail employees, must receive at least the federal minimum wage plus time-and-a-half for every hour worked over forty total hours in a workweek. For California workers, our clients configure the system to support daily overtime:
- 5 times the employee’s regular rate of pay for all hours worked more than eight hours up to and including 12 hours in any workday, and for the first eight hours worked on the seventh consecutive day of work in a workweek; and
- Double the employee’s regular rate of pay for all hours worked over 12 hours in any workday and for all hours worked over eight on the seventh consecutive day of work in a workweek.
